TERMS OF SERVICE

OVERVIEW

This website is operated by Couch Potato Furniture LLC. Throughout the website, the terms “we,” “us,” and “our” refer to Couch Potato Furniture LLC.

By visiting our website, purchasing a product, submitting information, or using any part of our services, you agree to these Terms of Service and the policies referenced in them. If you do not agree, please do not use the website or purchase our products or services.

Our Return and Refund Policy, Pickup and Delivery Policy, and Privacy Policy are incorporated into these Terms of Service.

  1. ONLINE STORE TERMS

You may use our website and services only for lawful purposes. You may not use our products, website, or services in any manner that violates applicable law or infringes the rights of another person.

You are responsible for providing complete and accurate contact, delivery, pickup, payment, and order information.

  1. PRODUCT CONDITION AND AVAILABILITY

Couch Potato Furniture LLC sells new, used, and refurbished furniture. Each product listing will identify the item’s applicable condition.

Used and refurbished furniture may have normal cosmetic wear, prior repairs, variations, or imperfections. We make reasonable efforts to photograph and describe material visible conditions accurately. Previously disclosed cosmetic wear or imperfections are not considered delivery damage or receipt of an incorrect item.

Colors and appearance may vary slightly because of lighting, photography, screens, and the surrounding environment.

Most used and refurbished couches are unique, one-of-one inventory. Adding an item to a cart does not reserve it. Products remain subject to availability until payment is completed and the order is confirmed.

  1. PRICING, TAXES, AND ORDERS

Prices may change without notice before an order is placed. Applicable sales tax, delivery charges, removal charges, and other selected services will be displayed or disclosed before the order is completed.

We may refuse, limit, or cancel an order when an item is unavailable, the listing contains a material pricing or description error, payment cannot be verified, fraud is suspected, or the order cannot safely or reasonably be fulfilled.

If we cancel an order after receiving payment, we will issue the appropriate refund.

Promotional offers, discounts, and negotiated prices may have separate terms and cannot be combined unless we agree otherwise.

  1. PAYMENT

By providing payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment providers to process the amounts associated with your order.

Orders using cash, Zelle, Venmo, or another manually arranged payment method are not confirmed until payment is received or we confirm the arrangement in writing.

Payment processing services may be governed by additional terms from the applicable payment provider.

  1. CUSTOMER PICKUP AND LOCAL DELIVERY

Customer pickup and local delivery are available only by confirmed appointment. A requested date or time is not guaranteed until we confirm it.

Customers must provide accurate information regarding the address, parking, stairs, elevators, gates, doorways, hallways, carrying distance, and other access conditions.

The customer is responsible for selecting a service level appropriate for the location and providing any assistance required by that service. Undisclosed or unsafe access conditions may require an additional charge, a different service level, or rescheduling.

Free customer pickup, standard local delivery, white-glove delivery, and old-couch removal are governed by our Pickup and Delivery Policy.

Completed delivery, white-glove, removal, and other service charges are nonrefundable except where required by law or when a confirmed problem was caused by us.

  1. INSPECTION, RETURNS, AND REFUNDS

Customers should inspect the couch when it is delivered or picked up.

Eligible returns are governed by our Return and Refund Policy, including the 30-day return window, condition requirements, approval process, transportation responsibilities, and applicable 20% restocking fee.

The restocking fee is waived for an approved exchange or trade toward a different couch. The fee does not apply when we confirm that the wrong item was provided or that damage was caused by us.

Delivery damage or receipt of an incorrect item should be reported within 48 hours with clear photos. This reporting period helps us investigate what occurred and does not eliminate rights that cannot legally be waived.

  1. OLD-COUCH REMOVAL

Old-couch removal must be arranged before the delivery appointment. The customer must accurately disclose the item’s size, condition, location, access requirements, and any known contamination or pest concerns.

We may refuse to handle or remove an item when it presents an undisclosed safety hazard, pest exposure, unsafe contamination, severe structural instability, or access conditions materially different from those disclosed.

  1. ACCURACY OF WEBSITE INFORMATION

We make reasonable efforts to keep website information accurate and current. However, typographical errors, omissions, pricing errors, or outdated availability information may occasionally occur.

We may correct errors or update information and may cancel an affected order when necessary. If an order is canceled after payment because of our error, we will issue the appropriate refund.

  1. THIRD-PARTY SERVICES AND LINKS

Our website may provide access to third-party services, payment processors, applications, or websites. We do not control and are not responsible for third-party content, availability, security, or practices.

Your use of a third-party service may be governed by that provider’s separate terms and privacy policies.

  1. PRIVACY

Personal information submitted through the website is handled according to our Privacy Policy.

You agree to provide accurate information and to keep your contact and order information current so that we can complete transactions and communicate with you when necessary.

  1. INTELLECTUAL PROPERTY

The website and its original text, graphics, branding, photographs, logos, layout, and other content belong to Couch Potato Furniture LLC or are used with permission.

You may not reproduce, sell, distribute, modify, or commercially exploit our website content without prior written permission.

  1. PROHIBITED USES

You may not:

  • Use the website for unlawful, fraudulent, abusive, or misleading activity.

  • Attempt to interfere with the website’s security or operation.

  • Introduce viruses, malicious code, or automated scraping tools.

Used and refurbished products are sold in the condition accurately described and photographed in their individual listings, subject to our Return and Refund Policy. Nothing in these Terms makes an undisclosed defect acceptable or overrides the specific representations made in a product listing.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Couch Potato Furniture LLC will not be liable for indirect, incidental, special, or consequential losses arising from the use of the website, products, or services.

Nothing in these Terms limits liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other non-waivable consumer rights.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to be responsible for claims or losses resulting from your unlawful use of the website, your material violation of these Terms, or your infringement of another person’s rights.

  1. SEVERABILITY

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

  1. WAIVER AND ENTIRE AGREEMENT

Our failure to enforce a provision does not waive our right to enforce it later.

These Terms and the policies posted on our website constitute the agreement between you and Couch Potato Furniture LLC concerning your use of the website and purchase of our products and services.

These Terms are governed by the laws of the State of California and applicable federal law, without limiting any consumer rights that apply based on the customer’s location.
